These Terms of Use ("Terms") govern your use of the Meditation Stillness mobile application ("App") developed by Anthony Scott Whitehead ("Developer," "we," "us," or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.
1. Description of Service
Meditation Stillness is a meditation timer application available for iOS. The App offers a 15-day free trial with full access to all features. After the trial period, users may continue using the App with a limited set of features ("Basic mode") or purchase a one-time premium unlock to restore full access.
2. Free Trial
New users receive a 15-day free trial beginning at the time of first use. During the trial, all features are accessible. When the trial expires, access to certain premium features will be restricted. The trial period cannot be extended or restarted.
3. In-App Purchase
The App offers a one-time, non-consumable in-app purchase ("Premium") that permanently unlocks all features. The purchase is processed through Apple's App Store and is subject to Apple's terms and conditions. The purchase price is displayed in the App at the time of purchase.
All payments are handled by Apple. We do not collect or store any payment information. Refund requests must be submitted through Apple. For more information, visit Apple's refund support page.
4. Basic Mode Features
After the free trial expires, the following features remain fully available at no cost: meditation timer with all controls, session tracking, current streak, session count, achievement count, all 62 achievements, daily goals, streaks, reminders, and a selection of meditation sounds. Premium features include the full sound library, detailed statistics with calendar view, iCloud sync, data export and import, and quick-start customization.
5. User Data
Your meditation session data is stored locally on your device. If you have purchased Premium, your data may also be synced via iCloud. We do not collect, transmit, or have access to your personal meditation data. Please refer to our Privacy Policy for more information on how we handle your data.
6. Acceptable Use
You agree to use the App only for its intended purpose as a personal meditation tool. You may not reverse engineer, decompile, disassemble, or attempt to derive the source code of the App. You may not redistribute, sublicense, or resell the App or any of its content.
7. Intellectual Property
All content within the App, including but not limited to audio files, graphics, text, and software, is the property of the Developer or its licensors and is protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.
8. Disclaimer of Warranties
The App is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components. The App is not a substitute for professional medical or mental health advice, diagnosis, or treatment.
9. Limitation of Liability
To the maximum extent permitted by applicable law, the Developer shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising out of or in connection with your use of the App. Our total liability for any claim arising from these Terms shall not exceed the amount you paid for the App.
10. Changes to These Terms
We reserve the right to update or modify these Terms at any time. Any changes will be reflected by updating the "Last updated" date at the top of this page. Your continued use of the App after any changes constitutes your acceptance of the revised Terms.
11. Apple's Standard EULA
Your use of the App is also subject to Apple's Standard Licensed Application End User License Agreement ("Standard EULA"), which can be found at Apple's Standard EULA page. In the event of any conflict between these Terms and Apple's Standard EULA, Apple's Standard EULA shall prevail.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Oregon, United States, without regard to its conflict of law provisions.
